The EU Registered Your Cellulose Ether Imports, and the Duty Comes Later
Case AD760 will decide a duty on Chinese cellulose ethers by November 2027, and the Commission has already said it will register imports
The EU opened an anti-dumping case on Chinese cellulose ethers on 24 September 2026 and intends to register imports, which is how a later duty reaches backwards. No duty exists and none can before 24 April 2027. On one 20-foot container the exposure runs from nothing to a five-figure bill.
AI Summary
The European Commission opened an anti-dumping investigation into cellulose ethers from China and Korea on 24 September 2026 and stated in the notice that it intends to register imports early, which is the mechanism that lets a later duty be collected retroactively. No duty exists and none can be imposed before 24 April 2027. The first argument window closed on 4 October 2026, and the exposure on one container ranges from nothing to 25,000 dollars depending on a rate nobody has published.
Case AD760 opened on 24 September 2026 and the Commission said, in the notice itself, that it intends to instruct customs authorities to register imports at an early stage. Registration is not a duty. It is the mechanism that lets a duty be charged later, on goods that entered before any duty existed.
The Commission intends to instruct customs authorities to register imports of certain cellulose ethers, originating in the PRC and Korea at an early stage of this investigation.
That paragraph is the whole article. Everything else is dates.
What happened
The European Commission opened an anti-dumping investigation into certain cellulose ethers from China and the Republic of Korea on 24 September 2026, under Article 5 of Regulation (EU) 2016/1036. The complaint came from Ashland Industries Nederland BV, Ashland Specialties Belgium BV and SE Tylose GmbH & Co. KG, and was lodged on 10 August 2026.
The product is defined by chemistry rather than by use. Six cellulose ethers are in scope, named by CAS number: methyl cellulose, hydroxyethyl cellulose, hydroxyethyl methyl cellulose, hydroxypropyl methyl cellulose, ethyl hydroxyethyl cellulose and methyl ethyl hydroxyethyl cellulose. The notice adds “regardless of colour, physical form, or grade” — so viscosity grade, which is what a buyer usually specifies, does not take a consignment out of scope.
The tariff entry is CN ex 3912 39 85, with three TARIC codes: 3912 39 85 30, 3912 39 85 60 and 3912 39 85 90.
Why now
Three clocks started on 24 September 2026 and they run at different speeds.
The fast one has already stopped. Comment on the product scope closed ten days after publication, on 4 October 2026. Hearing requests and comment on provisional measures closed fifteen days after publication, on 9 October 2026. If you import cellulose ethers and wanted to argue that your grade is not the product under investigation, that argument had a deadline and it passed.
The slow one is the one that costs money. Under Article 7(1) of the basic Regulation, provisional measures can be imposed no earlier than 60 days after initiation and no later than seven months — eight at the outside. From 24 September 2026, seven months is 24 April 2027 and eight months is 24 May 2027. Under Article 6(9) the investigation concludes within a year, and not more than fourteen months: 24 September 2027, or 24 November 2027 at the outside.
The third clock has no published start date at all, and it is the one to watch. The registration regulation will be published “in due time”, and the notice says “at an early stage”. Between the closed comment window on 4 October 2026 and the earliest possible provisional duty on 24 April 2027 there are 190 days in which registration can be ordered while nothing is payable.
So what
Registration is the cheapest tool the Commission has, and that is exactly why it is the one to plan for. A registration regulation imposes no duty and raises no revenue question, so it can be adopted early without the evidential work that a provisional duty needs. What it does is create a retrospective liability whose size is unknown at the moment the goods clear.
The mechanics matter for anyone modelling landed cost. An ad valorem anti-dumping duty is charged on the CIF value of the goods, and retroactive collection reaches the consignments that were registered. So the exposure is not a share of your margin. It is a percentage of what you paid for the goods, applied to every entered consignment inside the registration window.
Take one 20-foot container holding 18 tonnes of cellulose ethers at a stated CIF value of 50,000 dollars, which is 2.78 dollars a kilogram, and apply the range:
| Rate on CIF value | Duty on the container | What it does to a 15 percent gross margin |
|---|---|---|
| 0% | $0 | nothing — the case closes without measures |
| 10% | $5,000 | takes about a third of the gross margin |
| 25% | $12,500 | takes most of it |
| 50% | $25,000 | exceeds the gross margin on the container |
The 50,000 dollars is a stated input, not a market price. The point of the table is the shape rather than the numbers: the top row and the bottom row differ by 25,000 dollars on a single container, and the decision between them is made inside the Commission, not in your negotiation.
For you
- Buyer with a landed-cost model already: add a line for a registered-import provision at whichever rate you carry for contingency, and set it against CIF value rather than unit price, because CIF is the base the duty uses. The number to carry is the CIF exposure, not the per-kilogram increase. Where freight is a separate line on the invoice, the same discipline applies to the index mechanism - see the two errors in linking a contract to a freight index.
- Buyer without one: the useful question is not whether a duty arrives but how much of your next twelve months of CIF value sits inside the registration window. If registration is ordered in January 2027 and definitive measures land in November 2027, then ten months of your intake is registered. The landed-cost method shows where to put the line.
- Anyone holding stock: registered imports are identified by customs entry, so the consignments carrying the contingent liability are the ones entered inside the window, whether or not you still hold them. For how the EU charges duty per item rather than per consignment, see the EU per-item customs charge.
- Exporters and their agents: the notice defines the product by CAS number across six ethers and then removes grade as a distinguishing feature, so a specification argument is a product-scope argument and the scope window closed on 4 October 2026. The question worth answering early is whether the exporting entity is likely to be sampled, because an individual margin follows from the sample and the duty that attaches to your customer follows from the margin.
How confident
Confirmed. The notice number, the product scope by CAS number, the TARIC codes, the investigation period, the complainants, the complaint date, the registration paragraph, the seven-to-eight-month provisional window, the fourteen-month outer limit and the ten and fifteen-day comment windows are all read directly from Notice C/2026/6637 in Official Journal C/2026/4924, and the case timetable is corroborated by the Commission’s trade-defence register entry for AD760.
Inferred. The 50,000-dollar container and the 18-tonne net weight are stated inputs chosen to make a percentage into a bill, not market observations. The 0 to 50 percent range is a range and not a forecast: no rate exists, none can exist before provisional measures, and any figure presented as an expected rate would be an invention. The dates 24 April 2027 and 24 May 2027 are the notice’s own seven and eight-month limits, not scheduled decisions.
What would change my mind. A published registration regulation would fix the start of the liability window and move the useful question from “when” to “how much”. A sampling decision naming the exporting producers would narrow the rate, because individual margins follow from the sample. And a notice that the Commission does not intend to impose provisional duties would move the exposure out to the definitive stage and change the arithmetic entirely — the notice provides for exactly that outcome, by information document.
The data point
The comment window on the product scope closed 4 October 2026 and the earliest possible provisional duty is 24 April 2027. One hundred and ninety days separate a deadline that already passed from a duty that cannot yet exist, and registration can be ordered anywhere inside that stretch.
FAQ
Is there a duty on Chinese cellulose ethers now?
No. On the date of writing no anti-dumping duty applies to cellulose ethers from China or Korea. What exists is an investigation opened on 24 September 2026 and a stated intention to register imports. Under Article 7(1) of Regulation (EU) 2016/1036 a provisional duty cannot be imposed earlier than 60 days after initiation, and the notice puts the outer limit at eight months, which is 24 May 2027. So a duty is possible from late April 2027 and impossible before then.
What does registration actually change for me?
It creates a contingent liability on consignments that enter after the registration regulation is published. You pay nothing at the border. If definitive duties are later imposed, the Commission can collect them retroactively on the registered imports, which means a bill arriving after the goods have been sold. The size of that bill depends on a rate that has not been calculated yet, so registration converts a known cost into an unknown one without changing the amount payable today.
Can I avoid the exposure by changing my supplier?
Partly, and only for the country dimension. The case covers the People’s Republic of China and the Republic of Korea. A supplier in a third country is outside the scope of this investigation, but two things decide whether that helps: whether the goods are actually originating in a third country under the non-preferential origin rules, and whether a separate case covers them. Buyers should also expect the registration obligation to attach to the importer of record rather than to the exporter, which is where the liability sits in practice.
Does my viscosity grade fall inside the product scope?
The notice defines the product by CAS number and then says “regardless of colour, physical form, or grade”. Viscosity grade is a specification of the same chemical, so it does not take a consignment out of scope on the face of the notice. The window to argue about product scope closed on 4 October 2026. An argument that a particular grade is a different product is now something to raise through the file rather than through the scope consultation.
When does this end?
Under Article 6(9) the investigation concludes within one year of publication, and not more than fourteen months. From 24 September 2026 that is 24 September 2027, or 24 November 2027 at the outside. The notice also sets out the standard sequence: information on planned provisional duties four weeks before they are imposed, three working days to comment on the accuracy of the calculations, and definitive measures at the end. The register entry for AD760 shows definitive measures expected on 20 November 2027.
How we calculated this
Two calculations, both stated so they can be redone.
duty on a consignment = CIF value x rate
stated container: 18,000 kg at 50,000 dollars CIF
= 2.78 dollars per kg
at each rate, CIF value 50,000 dollars:
0% = 0
10% = 5,000
25% = 12,500
50% = 25,000
range = 25,000 - 0 = 25,000 dollars per container
registration window in which duty can be ordered
while nothing is payable:
4 October 2026 -> 24 April 2027
= 202 days
The duty figures convert a percentage into a bill. An ad valorem anti-dumping duty is charged on the CIF value entered, so the arithmetic is CIF value multiplied by the rate. The container is stated at 50,000 dollars CIF and 18 tonnes net, which is 2.78 dollars a kilogram — a reader input, not a published price. The rate range is 0 to 50 percent. The table reports the four rates rather than a single expected one, because the Commission has published no rate and any single number would be invented.
The 190-day figure is the gap between two dates in the notice: 4 October 2026, which is ten days after publication and the close of the product-scope window, and 24 April 2027, which is seven months after publication and the earliest date Article 7(1) allows for provisional measures. It measures the period in which registration can be ordered while no duty is payable.
Both the tariff heading and the product definition come from Notice C/2026/6637. The case timetable is corroborated by the European Commission’s trade-defence register at case AD760.
The point
The question importers are asking about AD760 is what the duty will be. That question cannot be answered, and the more useful one is when the liability starts. The Commission has told you: it intends to register imports early, and registration is what makes a later duty reach backwards. On one 20-foot container the difference between no duty and a 50 percent duty is 25,000 dollars, and that difference is created by a regulation that can be published any day between now and 24 April 2027 without a single euro becoming payable at the time.
